Privacy Policy

Welcome to Ecole Intuit Lab Kolkata, which is one of the four Indian campuses of École Intuit Lab and was established in 2019 in collaboration with Techno India University, a university established under the West Bengal Act 2012 (West Bengal Act XX of 2012) (hereinafter referred to as “University" or “us” or “we” or “our”).

The University is the owner and operator of https://ecole.campusjadugar.com/ (here in after referred to as the “Platform”), and we have formulated this Privacy Policy (hereinafter referred to as the “Policy”) in accordance with the Information Technology Act, 2000 of India and the rules made thereunder, and Digital Personal Data Protection Act, 2023.

This Policy describes the University’s policies and procedures on the collection, use, and disclosure of your information when you use the Platform and tells you about your privacy rights. We are committed to safeguard the privacy of our students, users, visitors, and all other persons who use our Platform (hereinafter referred to as “you”, “User” and “your” as the context may require).

By using this Platform and voluntarily providing us with identifiable Personal Data, you are consenting to our use of it in accordance with this Policy and applicable laws. This Policy applies to the use of the Platform, by providing the required information for signing in, and any other personal information you communicate on call or email or in person.

If you do not agree with this Policy, please do not proceed further to use / access our Platform. Your continued use of the Platform shall be deemed as acceptance to this Policy.

This Policy is a part of our terms of use. Unless otherwise defined in this Policy, the terms used in this Policy shall have the same meaning as in our Terms of Use. In the event, we collect your Personal Data and process it for any other purpose, we will treat it as per this Policy and relevant applicable laws. We may update this Policy from time to time. While we will always endeavour to notify you, you must periodically review the Policy for the latest information on our privacy practices.

1. DEFINITIONS

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

  • 1.1. “Account” means a unique account created for you in order to use the Platform;
  • 1.2. “Consent” of the User refers to the freely given, specific, informed, and unambiguous indication of the User’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her;
  • 1.3. “Cookies” are small files that are placed on your device by a website, containing the details of your browsing history on that website among its many uses;
  • 1.4. “Personal Data” means any information relating to the User, who can be identified, directly or indirectly, particularly referring to identifiers such as the name, an identification number, email, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of the User, or any other information of similar nature;
  • 1.5. “Third-party” means a natural or legal person, public authority, agency or body other than the User, the University and persons who under the direct authority of the University, are authorised to process personal data;
  • 1.6. “User” means any person(s), who visits, uses, deals with the Platform.

2. USE AND DESCRIPTION OF THE PLATFORM

The Platform, licensed by the University, is a unique integrated campus management platform curated for students and faculty of the University. The Platform facilitates activities such as course management, attendance tracking, performance evaluation, communication, and access to other University-related resources. Through the Platform, the University collects, manages, and processes information essential for academic, administrative, and communication purposes.

3. INFORMATION COLLECTED

This Policy applies to the Personal Data provided by the User and any other data that the User provides for accessing or availing the Services, as specified in Clause 5, through the usage of our Platform.

4. CONSENT

By using the Platform, providing us with your Personal Data, or by making use of the features provided by the Platform, you hereby provide your Consent to the collection, storage, processing, disclosure, and transfer of your Personal Data in accordance with the provisions of this Policy.

You acknowledge that you are providing your Personal Data out of your free will directly to the University. You have the option to not provide us with the Personal Data sought to be collected.

You will also have an option to withdraw your consent at any point, provided such withdrawal of consent is intimated to us in writing to Mr. Shelton Ward, Student and Academic Co-ordinator, at tiu.eilkops@technoindiaeducation.com. Your withdrawal of consent shall not affect the processing of Personal Data that was done before your withdrawal of consent.

5. PERSONAL DATA

To enable you to use our Platform efficiently, we will use the Personal Data and any other information provided to us by you while accessing the Platform, to contact or identify you, including but not limited to, your full name, address, qualifications, mobile number, age, your email address, and your location. If you communicate with us by email or phone, any information provided in such communication may be collected as Personal Data.

The primary purpose of collecting this information is to enhance your experience by providing a smooth, efficient, and customized interaction with the Platform. Personal Data is also essential for enabling you to create and manage an account, access academic and administrative services, and utilize the features provided by the Platform effectively. You may update certain information through your account settings on the Platform at any time to ensure accuracy and relevance.

6. LOG FILE INFORMATION

Each time you access the Services on the Platform, your browser or mobile device automatically reports information from log files. Our servers automatically capture specific log file information when you use our Services. These server logs may contain anonymous data about your web request, browsing history, browser type, referring and exit pages and URLs, device usage information, the number of clicks you make and your interactions with Platform links, domain names, landing pages, the pages you view, and other similar data.

In addition to server logs, we utilize Google Analytics, logs analyzers, and similar tracking technologies to monitor and analyse activity on our Platform. These technologies help us gather insights into user behaviour, optimize our Services, and enhance User experience.

7. USE OF THE PERSONAL DATA

The purpose of collecting the Personal Data is to provide the User and to allow them the access to the Platform. We may use the information provided by the User, including but not limited to, for the following purposes:

  • i. To identify and communicate with the User;
  • ii. To facilitate and support the delivery of educational and academic services offered by the University;
  • iii. To supervise, administer, and monitor the use of the Platform;
  • iv. To resolve technical issues that may hinder the User’s access or use of the Platform;
  • v. To provide additional information to the User about the courses and academic activities offered by the University;
  • vi. To enable features such as rewards, credits, notifications, and other functionalities offered through the Platform;
  • vii. To better understand Users' needs and interests for enhancing the services offered by the University;
  • viii. To deliver a personalized and customized experience for Users;
  • ix. To improve the quality, functionality, and overall user experience of the Platform, including its content, design, and structure;
  • x. To detect and safeguard against errors, fraud, or any other unauthorized or criminal activities;
  • xi. To make disclosures as required under applicable laws and regulations.
  • xii. to detect and protect the University against any error, fraud or other criminal activity;
  • xiii. to make disclosures as may be required under applicable law.

We may share your Personal Data in the following situations:

  • i. With Service Providers: We may share your personal information with Service Providers to monitor and analyse the use of our Platform.
  • ii. With partners: We may share your information with our partners to offer you certain Platforms, services.
  • iii. With Your consent: We may disclose your personal information for any other purpose with your consent.

8. RETENTION OF YOUR PERSONAL DATA

The University will retain your Personal Data only for as long as is necessary for the purposes set out in this Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our legal agreements and policies.

9. STORAGE AND TRANSFER OF YOUR PERSONAL DATA

Your information, including Personal Data, will be stored as per the appropriate security procedures of the University and shall be accessible only to the appropriate personnel within the University.

Your information, including Personal Data, is processed at the University’s operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to and maintained on computers located outside of your state, province, country or other governmental jurisdictions where the data protection laws may differ than those from your jurisdiction. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

The University will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Policy, and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

However, you understand and accept that there’s no guarantee that data transmission over the Internet will be completely secure and that any information that you transmit to us is at your own risk. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security. We assume no liability for any disclosure of information due to errors in transmission, unauthorized third-party access to our Website and databases, or other acts of third parties, or acts or omissions beyond our reasonable control and you shall not be entitled to hold the Company responsible for any breach of security.

10. DISCLOSURE OF PERSONAL DATA

We will not sell or trade your Personal Information to third-parties without obtaining your consent for the same. This however does not apply to any storage or transfer to and from server/website hosting partners and other parties who assist us in operating the Platform, conducting our business. We may also release your information only when we believe that release is appropriate to comply with the law, enforce our site policies, or protect ours or others’ rights, property, or safety. We may disclose your information to protect and defend the rights or property of the University and to safeguard the University from any legal liabilities.

11. DISCLAIMER

We shall not be held accountable for any losses, damages, cost or other liabilities whatsoever arising with the use of the Platform through any Third Party, connection failure, the introduction of any broadcast while operating the Platform, error, any unauthorised virus, worm, or damaging component or issues in your system leading to possible damage or loss. We shall not be held liable for any exceptional, overall, indirect, direct or significant damages that may have risen from the use or inability to use the Platform.

The University makes no representations or warranties, express or implied, regarding the operation, functionality, or availability of the Platform. The University is not responsible for any losses, damages, costs, or other liabilities arising from:

  • i. The use of the Platform through third-party services, integrations, or applications;
  • ii. Any connection failures, interruptions, delays, or unavailability caused by network issues, server downtime, or technological factors beyond our control;
  • iii. The introduction of unauthorized broadcasts, viruses, worms, damaging components, malware, or security breaches affecting the User’s system or data;
  • iv. Technical errors, defects, glitches, or omissions in the Platform’s functionality, whether caused by the University or third-party service providers, including Campus Jadugar or any server hosting partners;
  • v. Issues arising from third-party server hosting providers, including outages, disruptions, data loss, or delays affecting access to or functionality of the Platform;
  • vi. Delays or disruptions caused by updates, upgrades, maintenance, or changes to the Platform made by Campus Jadugar or any associated service providers;
  • vii. Any incompatibilities or system failures affecting the User’s device, software, or data resulting from the use of the Platform;
  • viii. The inability to access or use the Platform due to technical issues, scheduled maintenance, or factors beyond the University’s reasonable control;
  • ix. Errors or inaccuracies in any information, content, or services provided through the Platform.

The University does not warrant or guarantee the accuracy, reliability, completeness, or uninterrupted operation of the Platform. Any updates, upgrades, or changes to the Platform carried out by Campus Jadugar or the server hosting provider are beyond the University’s control, and we disclaim all liability for any consequences arising from such modifications.

The User acknowledges and agrees that the University’s role is limited to licensing and facilitating access to the Platform. The User assumes full responsibility for their use of the Platform and associated risks, including but not limited to the performance, stability, or reliability of services provided by third-party partners.

Server Hosting and Platform Functionality
The University has licensed the Platform from Campus Jadugar and does not own or operate the underlying server infrastructure or software. Any issues or disruptions in the Platform arising from actions, omissions, or negligence of Campus Jadugar or the hosting partner, including updates, bugs, data loss, or performance issues, are not the responsibility of the University.

Limitation of Liability
In no event shall the University be held liable for:

  • Any exceptional, indirect, consequential, special, or punitive damages, including but not limited to loss of profits, revenue, goodwill, data, or business opportunities arising from the use, misuse, or inability to use the Platform;
  • Any damages or liabilities resulting from failures or omissions on the part of Campus Jadugar, the server hosting provider, or other third-party service providers supporting the Platform’s functionality.

12. SECURITY AND CONFIDENTIALITY

We employ administrative, physical, and technical measures designed to safeguard and protect information under our control from unauthorised access, use, and disclosure. At the time of collecting, maintaining, accessing, using or disclosing your Personal Data we shall do so by using systems and processes consistent with industry standards in information privacy and security.

It is the responsibility of the User to protect the privacy and security of their email account and phone numbers so that it is not accessed by third parties.

We undertake to protect your information with utmost confidentiality.

13. USER’S RIGHTS

The University undertakes to respect the confidentiality of your Personal Data and to guarantee that you can exercise your rights. You have the following rights under this Privacy Policy, and by law:

  • i. Request access to your Personal Data. The right to access, update or delete the information we have of you. Whenever made possible, you can access, update or request deletion of your Personal Data directly within your account settings section. If you are unable to perform these actions yourself, please contact us to assist you. This also enables you to receive a copy of the Personal Data we hold about you.
  • ii. Request correction of the Personal Data that we hold about you: You have the right to have any incomplete or inaccurate information we hold about you corrected.
  • iii. Withdraw your consent. You have the right to withdraw your consent on using your Personal Data. If you withdraw your consent, we may not be able to provide you with access to certain specific functionalities of the Platform.

You may exercise your rights of access, rectification, cancellation and opposition by contacting us.

14. CHILDREN’S PRIVACY

We do not knowingly collect personally identifiable information from anyone under the age of 16. If you are a parent or guardian and you are aware that your child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from anyone under the age of 16 without verification of parental consent, we take steps to remove that information from our servers. We rely on consent as a legal basis for processing Personal Data, hence, we may require the parent’s consent before we collect and use that information.

15. LINKS

Our Platform may contain certain links to other third-party sites such as payment gateways, platforms and it is not necessarily under our control. These third-party sites may collect data or solicit Personal Data from the Users, including payment details, for which we are not responsible or liable. We are also not responsible for the privacy practices of such third-party sites. We encourage you to read the privacy policies of that website before accessing / visiting it. If you decide to visit a third-party website linked to our Platform, you do this entirely at your own risk. We will not be responsible for the use of any Personal Data that our User voluntarily discloses on any other website / platform.

16. CHANGES TO POLICY

We reserve the right to change or remove any part of the Policy without notice or liability to any Third Party. We are in no way obligated to inform or give notice when there is a change in the Policy. However, reasonable effort to intimate our Users will be taken from our side. If the User wishes to discontinue using our Platform, then they can deactivate their account from the website directly. Unless stated otherwise, our current Policy applies to all information about the User and their account. A continued usage of the Platform after a notice of change has been sent to you or published on the Platform shall constitute your consent to the changed terms.

18. JURISDICTION

This Policy is prepared in accordance with the Indian laws. Any dispute between the User and us in relation to this Policy shall be brought and maintained exclusively in the competent courts of Kolkata, India.

19. DISPUTE RESOLUTION

Any dispute, claim or controversy arising out of, or relating to the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of these Policy, or to the Users use of the Platform or the Service or information to which it gives access, shall be determined by arbitration in India, before a mutually appointed arbitrator. Arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996. The seat of such arbitration shall be Kolkata, India. All proceedings of such arbitration, including, without limitation, any awards, shall be in the English language. The award shall be final and binding on the parties.
